New Bicycle Laws in NSW to Improve Rider Safety

Recent years of increased bicycle accidents and injuries have seen new laws put into place across NSW.

As of 1 March 2016, drivers need to give bike riders at least one metre of space when passing in a speed limit zone of 60km/h or less. When the speed limit is over 60km/h, this distance is required to be at least 1.5 metres. If a driver is unable to pass the bike rider in a safe manner, they must slow their vehicle and only pass when it is safe to do so with the minimum distance. Heavy vehicles, including buses and trucks, must provide a greater space than these minimum distances when passing a cyclist.

Remember that cyclists are legally allowed to ride two abreast in a lane, and to use a full lane as a vehicle would. In this case, the usual overtaking rules would apply for the safety of all involved. With 1,500 bike riders seriously injured and 11 riders killed each year on NSW roads, this law intends to improve rider safety and awareness and reduce the risk of damage, injury and death.

Also in place from 1 March 2016 is a new law that bike riders over the age of 18 must carry a form of photo identification with them while riding. This new rule is designed to aid identification and medical assistance in the case that an incident does occur. As of 1 March 2017, cyclists may occur a penalty if they are stopped by police for breaking the road rules and do not carry appropriate identification.

Time Limitations on Bicycle and Vehicle Accident Claims
